Based on Your Feedback: Changes to Unrepresented Customer Showing Form

The Unrepresented Customer Showing Form (TXR 1508) is used when a broker who does not represent the seller is showing a residential property to a prospective buyer the broker does not represent.

Why More Changes?

After the form went into effect, Texas REALTORS® received numerous questions about situations in which a customer already has a representation agreement but wants

to view a residential property with a different broker who does not represent them. Examples of when this might occur include:

  • The customer’s broker is out of town and asks another broker to show a property.
  • The customer wants to attend an open house while their broker is unavailable.
  • A buyer wants to see a new listing quickly and their broker cannot attend the showing.
  • A relocating buyer is working with a broker remotely and needs local access to properties.

What’s Changing Feb 25

To address these concerns, the following revisions will be made to the form effective Feb 25:

  • Clarification of written agreement requirements: Reworded to enhance consumer awareness that a broker must have a written agreement with a prospective buyer before showing residential property if the broker does not represent the seller.
  • Removal of reference to additional services: A separate written agreement is necessary if additional real estate brokerage services are provided after the property showing. However, because this may not be appropriate in cases where the customer is subject to an exclusive representation agreement with another broker, the provision regarding additional services has been removed to avoid any confusion or implication that the customer may enter into such an agreement with the showing broker.
  • New representation status checkbox: Customers may now indicate whether they have an existing representation agreement with another broker. If the box is not checked, it means the customer does not have one. Previously, the form could not be used if the customer was already represented. That restriction has been removed.

The updates allow a broker to handle these and similar situations more effectively, while clearly documenting the customer’s representation status.
